By accessing and using PhotonLabs' lead generation and digital advertising services ("Services"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

PhotonLabs provides lead generation and digital advertising services that help businesses identify, target, and acquire qualified prospects through various advertising channels including but not limited to:

• Google Ads and search engine marketing
• Social media advertising (Facebook, LinkedIn, Twitter, etc.)
• Premium advertising channels and industry publications
• Social network integration and referral programs

3. Qualification Process

PhotonLabs reserves the right to review and approve all client applications. Not all businesses may qualify for our services. Qualification criteria include but are not limited to:

• Business legitimacy and compliance with applicable laws
• Minimum budget requirements
• Industry compatibility with our advertising channels
• Target audience viability

4. Pricing and Payment Terms

Our services operate on a performance-based pricing model:

• Google Ads Channel: $40 per qualified lead
• Social Media Channels: $50 per qualified lead
• Premium Channels: $60 per qualified lead

Payment is due within 30 days of invoice date. A qualified lead is defined as a prospect who meets your predefined criteria and has actively responded to campaign materials by providing contact information or expressing genuine interest.

5. Lead Quality Guarantee

We guarantee that all charged leads will meet the qualification criteria established during the onboarding process. If a lead does not meet these criteria, you will not be charged for that lead. However, PhotonLabs is not responsible for the conversion rate or sales outcomes of qualified leads.

6. Client Responsibilities

Clients are responsible for:

• Providing accurate business information and target audience criteria
• Responding to qualified leads in a timely manner
• Maintaining compliance with all applicable laws and regulations
• Providing feedback on lead quality to help optimize campaigns
• Ensuring their business practices align with advertising platform policies

7. Intellectual Property

All content, trademarks, and data on this website, including but not limited to software, databases, text, graphics, icons, hyperlinks, private information, designs, and agreements, are the property of or licensed to PhotonLabs and are protected by copyright and intellectual property laws.

8. Privacy and Data Protection

PhotonLabs is committed to protecting your privacy. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

9. Limitation of Liability

PhotonLabs shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, even if PhotonLabs has been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by the client for services in the preceding 12 months.

10. Termination

Either party may terminate the service agreement with 30 days written notice. PhotonLabs reserves the right to terminate services immediately if the client violates these terms or engages in fraudulent or illegal activities.

11. Modifications to Terms

PhotonLabs reserves the right to modify these terms at any time. Clients will be notified of significant changes via email. Continued use of services after modification constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States. Any disputes arising from these terms shall be resolved in the courts of Tucson, Arizona.
